1. Who we are
CommunATI is operated by Bay Tech Ltd., a Manitoba corporation registered in Winnipeg. All references to "we," "us," "our," or "CommunATI" mean Bay Tech Ltd. acting through the CommunATI service.
2. What CommunATI provides
CommunATI is a platform for Canadian schools and community programs to publish events, manage registrations, run competitions and performances, log volunteer hours, and share kid-safe content with families. We do not run the underlying programs ourselves — member organizations do.
3. Accounts and member organizations
Member organizations are responsible for the accuracy of program listings, the qualifications of their volunteers and staff, and compliance with all applicable laws, including those governing work with minors. We may suspend or remove organizations that misuse the platform.
Individual accounts are for one person each. You are responsible for keeping your credentials secure and for activity under your account.
4. Kid-safe rules
CommunATI applies kid-safe defaults to every surface that displays minors: display names only (no first/last name on public pages), photo gallery access gated by family consent, and no third-party advertising or tracking. Member organizations and parents agree to use the consent controls and not bypass them.
5. Payments, donations, and sponsorships
Paid registrations, donations, and sponsor contributions are processed by Stripe. CommunATI receives a tokenized reference, never the full card number. Refunds are governed by the policy each organization configures for its events. Donations to Bay Tech Ltd. are not tax-deductible until our charitable status is granted; we will notify donors when this changes.
6. Content and intellectual property
You retain ownership of the content you upload (photos, scores, descriptions). You grant CommunATI a non-exclusive licence to display, distribute, and process that content as needed to operate the service. You agree not to upload content that infringes another party's rights or that is illegal under Canadian law.
7. Equipment lending between organizations
Equipment lending between member organizations is at the discretion of the lending organization. CommunATI provides the matching surface; we are not party to the lending agreement and accept no liability for loss, damage, or dispute. A lending agreement template is available before lending features open in your region.
8. Privacy
Your use of CommunATI is also governed by our Privacy Policy, which describes what we collect, why, how long we keep it, and how to request deletion or correction. PIPEDA (Canada) applies; PHIA applies where school divisions deploy.
9. Disclaimers and limitation of liability
CommunATI is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by Manitoba law, Bay Tech Ltd. disclaims all warranties (express or implied) and limits its liability for any claim arising out of your use of the service to the amount you paid us in the twelve months preceding the claim, or CAD $100, whichever is greater.
10. Termination
You may close your account at any time from Profile → Settings → Delete account, or by writing to privacy@communati.ca. We may suspend accounts that violate these Terms or that put other users at risk.
11. Changes to these Terms
We may update these Terms. When we do, we will update the date at the top and notify active users by email or in-app banner. Continued use after a change means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of Manitoba and the federal laws of Canada applicable therein. Any dispute will be heard in the courts of Manitoba.
